Frontpoint’s Photo and Video Submission Terms & Conditions
The following terms and conditions (these “Terms”) apply to any photos and/or videos you upload and/or submit to Frontpoint (“Content”):
Ownership and Permission: You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to use and share with Frontpoint Security Solutions, LLC (collectively with its affiliates, “Frontpoint") the Content, and that the Content submitted by you does not infringe upon the intellectual property rights of any third party, including but not limited to copyrights or trademarks. You also represent and warrant that you have express permission of everyone who appears in the Content (and their parent or guardian, if applicable) and their consent to have the Content shared with and used by Frontpoint in accordance with these Terms.
Frontpoint’s Use: You grant Frontpoint the worldwide, unrestricted, royalty-free, irrevocable, sub-licensable right to (a) use, reproduce, modify, adapt, publish, create derivative works from, distribute, and publicly display the Content in whole or in part in any medium or format now known or hereinafter created, for any purpose, including but not limited to promotional and marketing purposes, without compensation to you, and (b) use your name, commentary, and other information about you in connection with the Content. Frontpoint reserves the right to use, not use, or discontinue using the Content in its sole discretion at any time.
Content: You agree not to submit any Content that:
defames or invades the privacy or publicity rights of any person, living or deceased, or infringes upon any person’s or third party’s personal, property, privacy, or other rights;
is inappropriate, racial, sexually explicit, harassing, abusive, harmful, violent, or otherwise objectionable or offensive in any way;
contains any virus, worm, corrupt file, or other forms of malicious code or content that may harm a website or computer;
violates any applicable law, statute, ordinance or regulation.
Resolution: If you think any of your Content has been used without your permission or in violation of your rights, let us know so that we can try to work it out. You can reach us at [email protected].
Waiver and Indemnification: You irrevocably waive and hereby release Frontpoint from any and all claims, costs, expenses, damages, causes of action and/or liabilities, of any nature, whether direct or indirect, known or unknown, foreseen or unforeseen, arising out of or relating to the Content, including but not limited to claims for defamation, invasion of privacy, or violation of moral rights. You also agree to indemnify, defend and hold harmless Frontpoint from and against any losses, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to the Content or any breach by you of these Terms.
Enforceability: If any provision of these Terms is deemed invalid, illegal or otherwise unenforceable then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.
Age Requirement: You must be over the age of 18 to submit or upload Content.
By submitting Content, you signify your understanding and agreement to these Terms. If you do not agree with these Terms, please do not submit any Content to Frontpoint.
Employee Photo and Video Submissions
Frontpoint’s Photo and Video Submission Terms & Conditions and the Publicity paragraph of your Frontpoint Business Protection Agreement apply to any photos and/or videos you upload and/or submit to Frontpoint.
